Contracts: A Primer For Freelancers

Pick up your own copy here to read more on this topic and many others. In America, it is not standard for workers in most industries to sign binding employment contracts. But as more Americans pursue freelance work or independent contracting, they will need to comfortably navigate contracts and other formal work agreements. The COVID-19 pandemic seems to have accelerated an existing trend toward freelance work. In 2018, an estimated 20% of U.S. jobs consisted of independent contract and freelance positions. A survey from Upwork , a freelance job platform, set this figure as high as 36% in September 2020. Whether out of necessity or choice, many workers seem to be embracing self-directed positions. By its nature, freelance work means negotiating conditions with each client or employer. Freelancers who thrive thus build their skills in understanding, and sometimes creating, agreements that set the ground rules for a successful business arrangement. Such agreements define the scope of work, payment terms and other details. If your work is governed by a legally binding contract, evaluating the contract carefully before you sign is also a means of self-defense. Even if your freelance arrangement is something less formal, attentively reviewing the terms before you start work can save you major headaches later. Some freelancers use a “letter of agreement” (usually an email of agreement in practice). This is an informal written summary of the terms the freelancer and the client discussed. Others use a “statement of work” or “scope of work” agreement, which is more detailed than a letter of agreement but less formal than a full contract. Depending on the nature of your business, you may want to hire an attorney to help you create a formal contract template, which you can customize for each client. Or you may find one of these less-formal options sufficient for your needs. Considerations For Independent Contractors Independent contractors may sometimes take longer-term positions in which they work with a single client at a time. In these cases, the client may look more like an employer, though the contractor retains more independence than a traditional employee. For these workers, the first point of order is getting clear on the question of whether they are truly an independent contractor or if they should be treated as an employee. This question is not up to employer, or even worker, preference. The terms “independent contractor” and “employee” describe distinct ways of doing work on an employer or client’s behalf. Sometimes the distinction will be self-evident, but not always. Since 1978, the Internal Revenue Service has issued guidance to help employers make sure they are classifying their workers correctly. Hiring a freelancer is typically less expensive than hiring a full-time employee or agency. Industry Analysis Currently, 59 million people are freelancers in the United States, which is 36.7% of the 2020 U.S labor force. These numbers are expected to be 86.5 million and 50.9% respectively, by 2027. The company notes in its investor presentation that the addressable market in the U.S. is $115 billion. At just over $200 million in revenue, there is plenty of headroom to grow. The majority of freelancing still happens offline but is gradually making its way online. Source Fiverr faces stiff competition from other freelance marketplaces. Competitors include Upwork Inc (NASDAQ: UPWK ), Freelancer Limited ( OTCQX:FLNCF ), and Toptal LLC which is private. Although similar, they are slightly different than each other. Fiverr allows anyone to offer services on its platform. There are no vetting processes or skill tests required for freelancers. On the other hand, the other three do have a screening process with Toptal taking it to the extreme. Toptal only accepts less than 3% of all applicants after a five-step process. As a result, Toptal has a highly specialized talent pool. However, Fiverr does have a review system, so as long as someone hires a freelancer with good reviews then there shouldn’t be an issue. In addition, Toptal doesn’t allow its freelancers to set their own fees. Instead, it charges a buyer the market rate that would be expected outside of the platform. DETAILS: This is a part-time, freelance position to create content about marketing topics. The number of assignments you receive will be based on your availability, your skill sets, and content needed at that time. The amount of work you receive may vary from month-to-month, ranging from one assignment to four assignments or more. We do not assign more work than the freelancer can handle. We give writers at least seven days to complete an assignment. Responsibilities: • Follow the assignment instructions • Produce content that needs to be edited as little as possible • Able to take at least two writing assignments per month • Adhere to deadlines Required Skills • Experience writing marketing content (MUST have experience writing blog posts or thought leadership articles) • Excellent writing and editing skills (American English) • Expert knowledge about digital marketing and/or inbound marketing • Extremely good at following instructions • Understands how to read and follow an outline • Adheres to deadlines • Experience writing for different target audiences • Experience using Google Docs and Google Sheets • Dependable Helpful if: • Experience working in an agency or as an agency’s freelancer • 1+ year work experience as an editor or proofreader • 1+ year work experience using project management software • Experience writing content for SEO Candidates will be asked to submit at least 5 published pieces of content about marketing-related subjects that they’ve had published (can be a link to your portfolio or website, links to blog posts, links to websites they’ve written, brochure pdfs, etc.).
